This Messaging & Compliance Policy (“Policy”) governs the use of SMS, MMS, messaging infrastructure, telephone-number intelligence, campaign tools, APIs, automations, integrations, and related communications functionality made available by Reach Bullet (“Reach Bullet,” “we,” “us,” or “our”).
Reach Bullet provides communications technology and infrastructure. Customers determine who they contact, what they send, when they send it, and the legal basis upon which they communicate. Use of Reach Bullet does not independently establish consent or compliance.
This Policy applies to all messaging activity conducted through or in connection with Reach Bullet, including activity performed through the web application, APIs, automations, integrations, connected applications, or other supported interfaces.
You are responsible for compliance by your employees, contractors, agents, users, developers, customers, and other persons who use your Reach Bullet account or credentials.
For communications initiated through your Reach Bullet account, you are responsible for the messaging campaign and the underlying recipient relationship.
You determine:
Reach Bullet does not determine whether a particular recipient has consented to receive your communications.
Before sending a communication through Reach Bullet, you must obtain whatever consent, permission, authorization, contractual right, lawful basis, or other legal authority is required for that communication.
The type of consent required may depend on factors including:
You are responsible for determining the applicable standard before sending messages.
You must maintain records sufficient to demonstrate the consent, authority, or lawful basis upon which you rely.
Records should be maintained in a manner reasonably sufficient to identify, where applicable:
Reach Bullet may request such records in connection with a complaint, carrier inquiry, compliance review, legal demand, or investigation.
The fact that a telephone number or contact record was purchased, licensed, rented, obtained from a data provider, obtained from a lead vendor, or otherwise acquired from a third party does not by itself establish permission to send a message.
If you use third-party data, you are responsible for confirming that your acquisition and use of that data permits the specific communications you intend to send.
Reach Bullet does not independently verify the legal provenance or consent status of customer-uploaded contact data.
You must promptly honor valid requests by recipients to stop receiving communications where required by applicable law, regulation, industry practice, carrier requirement, or your own representations to the recipient.
Recipients may communicate revocation or an opt-out through methods recognized by applicable law or reasonably understood as a request to stop further messages.
You may not require a recipient to use an unnecessarily narrow or burdensome method to revoke consent where applicable law recognizes another reasonable method.
You may not intentionally continue promotional or other restricted messaging after an effective revocation.
Reach Bullet may provide automated processing for commonly recognized opt-out commands, including words such as:
The presence of automated keyword processing does not eliminate your responsibility to recognize and honor other valid opt-out requests where required.
You may not intentionally disable, bypass, overwrite, or circumvent Reach Bullet suppression functionality for the purpose of continuing to contact an opted-out recipient.
You are responsible for maintaining and using suppression information sufficient to prevent prohibited or unauthorized re-contact.
Reach Bullet may maintain platform-level suppression records or other controls where reasonably necessary to honor recipient requests, maintain network integrity, comply with provider requirements, or protect the Services.
Suppression records may be retained even after other customer data is deleted where retention is reasonably necessary to prevent renewed unwanted communications.
Where required by applicable law or industry requirements, communications must clearly identify the responsible sender, business, or brand.
You may not:
All message content must be lawful, accurate, and consistent with any disclosures or consent obtained from the recipient.
Messages may not contain:
You are responsible for ensuring that message frequency is consistent with applicable law, recipient expectations, your disclosures, and the scope of any consent obtained.
Excessive or unexpected messaging may result in complaints, carrier filtering, account restrictions, or enforcement action.
Certain laws or regulations may restrict the hours during which particular messages may be sent.
You are responsible for determining applicable time-of-day, quiet-hour, state, local, or recipient-location requirements and configuring campaigns accordingly.
Reach Bullet does not guarantee that a campaign's timing is legally permissible for every recipient.
Where applicable, you are responsible for complying with federal, state, internal, industry-specific, and other do-not-call or do-not-contact requirements.
Reach Bullet does not independently scrub your contact lists against every external registry or determine whether an exemption applies unless a specific feature expressly states otherwise.
Messaging traffic may be subject to requirements imposed by wireless carriers, aggregators, telecommunications providers, registries, infrastructure providers, and industry organizations.
You agree to comply with requirements applicable to your traffic, which may include:
Any brand registration, campaign registration, sender approval, number provisioning, technical approval, carrier acceptance, or similar process does not establish that you have legal permission to contact a particular recipient.
Technical availability of the Services is not legal approval of your campaign.
Reach Bullet may provide information regarding telephone numbers, such as:
Telephone-number intelligence does not indicate whether a recipient has consented to receive your communications and must not be treated as evidence of consent.
You are responsible for maintaining reasonable data hygiene, including removing or suppressing contacts that should no longer be messaged.
Reach Bullet may provide tools designed to assist with validation, list management, deduplication, suppression, or other processes, but use of such tools does not transfer compliance responsibility to Reach Bullet.
Where Reach Bullet provides automation, artificial intelligence, classification, routing, or automated-response functionality, you remain responsible for reviewing and configuring the resulting communication workflow.
You are responsible for determining whether automated responses, follow-up communications, classifications, or workflows are appropriate and lawful.
Messages initiated through APIs, webhooks, integrations, connected CRMs, spreadsheets, applications, or automated systems remain subject to this Policy.
You may not use an integration or API to bypass protections that would otherwise apply through the Reach Bullet interface.
You may not attempt to evade legal, platform, carrier, provider, or compliance controls by:
If Reach Bullet receives a complaint concerning your messaging, we may request information reasonably necessary to investigate.
You agree to promptly provide requested information, which may include:
Reach Bullet may conduct compliance reviews where reasonably necessary to protect the platform, respond to complaints, satisfy provider requirements, investigate suspected abuse, or manage legal or regulatory risk.
We may require customers to provide documentation regarding campaign purpose, consent, data source, sender identity, opt-in processes, or related compliance matters.
Reach Bullet may immediately restrict, pause, block, throttle, suspend, or terminate messaging activity where we reasonably believe:
Reach Bullet may take protective action before completing a full investigation where immediate action is reasonably necessary.
Reach Bullet may preserve, access, or disclose records where reasonably necessary to comply with applicable law, lawful legal process, regulatory requirements, carrier inquiries, fraud investigations, or telecommunications-provider requests.
Reach Bullet may cooperate with carriers, aggregators, registries, regulators, law enforcement, courts, and other appropriate parties where permitted or required by law.
Reach Bullet may provide features intended to assist customers with operational compliance, such as suppression functionality, telephone-number lookup, campaign settings, or other controls.
These features do not constitute legal advice and do not guarantee compliance.
You remain responsible for obtaining legal advice regarding your particular campaigns and business practices.
Your obligations under the Reach Bullet Terms of Service, including applicable indemnification obligations, apply to violations or alleged violations of this Messaging & Compliance Policy.
Without limiting the Terms of Service, you remain responsible for claims arising from your recipients, campaigns, contact data, consent practices, content, opt-out handling, or other messaging activity conducted through your account.
Telecommunications laws, carrier requirements, industry practices, and messaging standards may change over time.
Reach Bullet may update this Policy, technical controls, sending requirements, registration requirements, or platform functionality in response to such changes.
This Policy supplements the Reach Bullet Terms of Service, Acceptable Use Policy, Privacy Policy, and other policies incorporated into your agreement with Reach Bullet.
A violation of this Policy constitutes a violation of the Reach Bullet Terms of Service.
